1. Acceptance of the terms By accessing and using the ACENS platform, you accept these General Terms of Use (the "Terms"). If you do not agree with these terms, please do not use our service. ACENS reserves the right to modify these terms at any time. Changes will take effect upon their publication on this page. Your continued use of the platform after changes constitutes acceptance of the new terms. 2. Description of the service ACENS is an artificial intelligence photo editing platform for real estate professionals. The service allows you to: - Upload photos of properties - Process these photos with automated AI tools - Export the processed images - Manage projects and collaborate as a team The service is provided "as is" and may be subject to improvements and changes. 3. Registration and user accounts To use ACENS, you must create an account by providing accurate and complete information. You are responsible for: - Maintaining the confidentiality of your sign-in credentials - All activities carried out through your account - Notifying us immediately of any unauthorized use of your account Access to the platform is reserved for real estate professionals. ACENS reserves the right to refuse or suspend any account that does not comply with these terms. 4. User responsibilities By using ACENS, you agree to: - Upload only images to which you hold the rights - Not use the service for illegal or fraudulent purposes - Respect intellectual property rights - Not attempt to circumvent technical or security limitations - Not use scripts or bots to access the service in an automated manner without authorization 5. Intellectual property and usage rights Your images: You retain exclusive ownership of all images you upload to ACENS. By using our AI services, you grant us the right to process these images solely to provide the requested service. Processed images: The images modified by our AI belong to you. You may use them freely for your professional activities. ACENS platform: All content of the platform (design, texts, logos, software, algorithms) is the exclusive property of ACENS and is protected by copyright. Any unauthorized reproduction, modification or use is strictly prohibited. 6. Subscriptions and payments ACENS offers subscription plans with usage limits (number of images, storage, etc.). Payments are secured via Stripe. Renewal: Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account. Refunds: In the event of a proven technical problem preventing use of the service, contact us to review your refund request. Price changes: ACENS reserves the right to modify its prices. Changes will be announced 30 days before they take effect. 7. Limitation of liability ACENS strives to provide a reliable service but cannot guarantee: - Continuous availability of the service (interruptions for maintenance, updates, technical failures) - That AI results will perfectly match your expectations - Unlimited retention of data (see our retention policy) ACENS disclaims all liability for: - Direct or indirect damages resulting from the use of the service - Loss of data or images - Consequences of using the processed images in your professional activities 8. Data protection The collection and processing of your personal data are governed by our Privacy Policy, which complies with Swiss legislation (FADP) and the GDPR. By using ACENS, you consent to the collection and processing of your data as described in our privacy policy. 9. Suspension and termination ACENS reserves the right to suspend or terminate your account in the event of: - Violation of these Terms - Fraudulent use of the service - Non-payment of subscriptions - Activities harmful to the platform or to other users In the event of termination, you will have 30 days to retrieve your data before it is permanently deleted. 10. Governing law and jurisdiction These Terms are governed by Swiss law. In the event of a dispute, the exclusive place of jurisdiction is the competent court at the registered office of ACENS (Genève, Suisse). 11.
